Used Vehicle Lemon Law In California

Although the California Vehicle Lemon Law usually applies to new cars under warranty, there is also used vehicle lemon law regulations. There are certain stipulations that apply to used vehicle lemon law, though. The vehicle must not have been purchased for commercial purposes to be protected under vehicle lemon law, for starters.

The vehicle (vehicle, truck, RV, boat, etc.) must have been purchased for an individual, family, or household. If a used vehicle was bought with a warranty and the sellers had a certified mechanic establish whether any defects were present at the time of purchase, it may most likely be covered under the California Vehicle Lemon Law. If defects occurred that should have been covered under the warranty that were not spoken about at the time of purchase, used vehicle lemon law states that the seller must fix it or replace it. The vehicle lemon law applies to leased cars, as well, but only if they have a warranty.

The warranty covers a vehicle under California Vehicle Lemon Law so long as the first defect originated within the first 18,000 miles or 18 months, whichever is first. If the first attempt to repair the vehicle happened within the specific warranty period, a leased or purchased new or used vehicle can qualify under the used vehicle lemon law after that period, though. These laws are in place to protect consumers from all the harm inherent in owning a "lemon" and to allow them to get what they paid for.
