The Sequence Of Lemon Law Cases


Most of the Lemon Law cases that are filed under the jurisdiction of any court house all over the United States follow a certain sequence and almost sixty percent of them never reach the actual litigation stage. Most of the Lemon Law cases are solved in the pre-litigation stage.

The sequence of one of the Lemon Law cases goes as follows. First, a buyer purchases a vehicle, no matter the manufacturer's name. Then, he/she drives the vehicle around for a while until he/she notices that there is something wrong and the vehicle does not go as it should. The second phase in the Lemon Law cases sequence is the one in which the buyer decides to go back to the manufacturer and ask for repairs, refunds or replacements. Of course, in this first contact with the manufacturer, the later will try to intimidate the consumer, qualified technicians carefully inspecting the vehicle and coming up with the explanation that it was in fact the driver's fault for the malfunction.

Then, in the following phase of Lemon Law cases, the buyer goes back to the manufacturer after another period of time in which the vehicle was still not functioning properly. This time the manufacturer tries to delay the inspections and the evaluation as to make the buyer want to give up his/her tries. Eventually, the manufacturer agrees that there is something wrong with the vehicle but does not agree to total refunds or total cover of repairs.

The nest stage is the one in which the buyer obviously gets a little tired of all the trips back and forth to the manufacture's office and gets a Lemon Law cases attorney. In this phase, the attorney becomes the person in charge with negotiating with the manufacturer and even the legal representative of the buyer in case of lawsuit.

As previously stated, this is the phase most of the Lemon Law cases reach. Once the lawyer does his/her job, the manufacturer agrees to paying the expenses it owns to the buyer in order to avoid any further unwanted consequences related to a lawsuit that might occur.
