The Pattern Of Lemon Law Cases


Lemon law cases
are often following a pattern in their solving and that is why most of them never reach the court. This practice, called pre-litigation helps both the buyer and the manufacturer avoid unwanted expenses, on layers and state taxes.

This pattern of Lemon law cases goes as follows. First, the buyer buys a new vehicle, drives it for a while and notices that it does something wrong whenever started. Many things can go wrong with a car, none of them life threatening, but still important to be solved in time. Of course, the buyer decides to go back to the dealer and discuss the problem. Although his/her vehicle might not be the only one brought back, the dealer will never tell that to the buyer on their first meeting. Furthermore, most of the Lemon law cases are treated indifferently on their first occurrence by the manufacturers. One of the employees of the dealer will shortly take the vehicle for a drive, come back and say nothing's wrong with it. The thing that enables technicians to do and say that is the fact that most of the buyers confronted with Lemon law cases are not really specialists in vehicles and they'll believe whatever they are told. Still, buyers are not that easy to manipulate.



After a few visits to the dealer and still unresolved issues, the buyer decides to call a lawyer. This is in fact the second phase of the pattern most of the Lemon law cases follow. The respective attorney then sends a demand letter to the manufacturer, asking for refunds or repairs, to which the later has thirty days to respond. At this point, the prelitigation is almost successful. In order to avoid unwanted lawsuits and bad advertisement, the dealer will most of the times solve these Lemon law cases by returning the letter and by offering a settlement. This settlement can be either close to what the attorney demanded, in which case the deal is almost over, while other times it can be under the sum proposed. These lower offers will obviously be rejected by the lawyers and in order to eventually solve the Lemon law cases they're facing, the manufacturers will eventually make a serious offer and please the buyer.

Although it might seem like a simple pattern, it is in fact a complicated process to accomplish. You need to get the most experienced lawyers and make sure you'll get what rightfully yours.
