This law is also known as the Motor Vehicle Warranty Rights Act, and it states that any car that is in the warranty period and proves to be malfunctioning, so it cannot be used by its owner or causes serious injuries to its user, can be refunded or replaced. According to the California Lemon law the producer is responsible for any defect or problem of the car. The manufacturer is obliged to repair the vehicle, or if he cannot do this the company has to replace the car or to give the money back to the owner.

The California Lemon law allows you to file a lawsuit if a manufacturer refuses to repair, replace or refund a vehicle that was declared damaged. Also, the costs with repairing, and with the lawyer are assured by the Lemon law.

According to the California Lemon law owners of both new and used cars can ask for refund or replacement if it had been proved that the car is faulty. But the owner needs to prove that the defect isn't caused by him, and that it's a manufacturing one; that the vehicle has been repaired four times but it is still malfunctioning; or that the defect wasn't repaired in a period of time of 18 months or 18,000 miles.

In order to be sure that the California Lemon law will protect their rights and interests, the consumers must fallow the instructions from the User's Manual, must repair the vehicle only in authorized centers, and must file only a written complaint, because this is the only type of complaint recognized by the California Lemon law.
