Meeting Requirements Under California Lemon Law


California lemon laws are designed to protect the consumer from the purchase of an unsafe or malfunctioning vehicle. However, there are prerequisites that the vehicle must qualify under before the consumer can file a suit under the California lemon law. The most important factor in determining if a file can be filed is that the vehicle must still be under warranty from its purchase. Therefore, it is important for the consumer to report any defects in the vehicle as soon as they are noticed. Typically a vehicle is under warranty for around 18 months or 18,000 miles. This is the known warranty period made under an amendment to the California lemon law. Repair attempts must also be made before a full replacement or reimbursement can be issued.

Also under California lemon laws, manufacturers have the opportunity (or several) to repair the defective vehicle before they are required to replace it. Depending on the defect or damage to the car, the manufacturer has between 2 and 4 attempts to repair the vehicle. After four attempts to repair a slightly defected vehicle, or two attempts for a seriously defective vehicle, it is considered a lemon, and the consumer is then entitled to reimbursement under the California lemon law. Keep in mind that the repairs have to be made within thirty days. It is imperative that consumers keep records of all the repair invoices in order for their rights to be protected under California lemon laws.

California lemon laws also protect manufacturers from vehicle purchase. For example, if there are no attempts by the owner to repair the vehicle, the manufacturer is not required to reimburse or repair a lemon vehicle. If the owner has damaged the vehicle because of negligence or misuse, the law is also void. In order to qualify the vehicle under California lemon law, the defects must also impair the use of the vehicle, reduce its safety, or diminish its resale value.
